The victim was leaving her family house to meet her boyfriend on the night of the event. She came across Ngomane while walking. He stood in her way, blocking her path.
Ngomane dragged his victim to a neighbouring abandoned house and strangled her before biting off her tongue. He gave her a love potion bottle to drink, told her to strip, and then raped her.
The court was also surprised to learn that after raping his victim, Ngomane stayed the night with her and took her to a nearby river to wash the next day.
When the victim returned home the next morning, she awoke her mother and, using sign language, requested for a pen and paper so she could write down what had occurred to her.
Her parents escorted her to the crime scene, where they discovered a portion of her tongue on the ground. They brought it to Themba Hospital, where the woman received medical and psychosocial care.
Ngomane was detained shortly after the event was reported to the police. Ngomane had pled not guilty and disputed the charges. In a victim impact statement, the victim described how the incident had traumatised and shamed her.
The magistrate determined that there were no substantial and compelling reasons to deviate from the required minimum punishment.
He condemned Ngomane to life in prison for rape and seven years for assault with the intent to cause great bodily damage.
