Freedom Under Law (FUL) is set to initiate a legal challenge against the decision made by the Judicial Service Commission (JSC) regarding appointments to the Supreme Court of Appeal (SCA). The challenge comes in the wake of the JSC’s October interviews of ten candidates for four vacancies in the SCA.
Despite the interviews, the JSC only recommended Judge Fayeeza Kathree-Setiloane and Judge Anna Kgoele for appointment by the President, leaving the remaining two vacancies unfilled.
FUL deems the written reasons provided by the JSC for this decision as inadequate and failing to address the significant public concerns raised after the interviews. Consequently, FUL has resolved to pursue legal action and is instructing its legal representatives accordingly.
